How we collect, use, and protect your information when you use CargoPro.

Information We Collect

Mile Marker Technologies, LLC (“MMT,” “we,” “us,” or “our”) is committed to transparency about our information practices. This Privacy Policy describes how we collect, use, store, share, and protect information in connection with your use of the CargoPro application and related services (“Application”). By using the Application, you consent to the practices described in this Policy.

1.1 Carrier Account Information

When a fleet administrator registers a carrier account, we collect company name, USDOT number (if provided), MC number (if provided), administrator name, email address, contact phone number, and billing information. Billing card data is processed and tokenized by our third-party payment processor (Square) and is never stored in full on MMT’s servers.

1.2 Driver Records

Fleet administrators provide driver names and mobile phone numbers when provisioning driver accounts. This information is stored in our database and associated with your carrier account. It is used solely to create driver access credentials and to send SMS activation messages.

1.3 Inspection Records (“Carrier Data”)

When a driver submits a cargo securement inspection through the Application, we store:

  • Cargo type, weight (lbs), and load length (ft) as entered by the driver;
  • Field-by-field checklist results and any driver notes;
  • Server-validated pass/fail/review result, critical issues, warnings, and passed checks;
  • Load number (if provided);
  • Evidence photo URLs (if photos are attached);
  • Timestamp and whether the inspection was completed offline;
  • Dispute submissions, dispute categories, override decisions, and audit log entries;
  • Driver ID and carrier ID associated with the inspection.

These records constitute “Carrier Data” as defined in our Terms of Service and are accessible by the carrier’s fleet administrator through the fleet management console.

1.4 Evidence Photos

Photos captured through the Application as securement evidence are uploaded directly to secure cloud storage (Amazon S3) under pre-signed URLs. Photo storage is associated with your carrier account. Photos are encrypted in transit using TLS and at rest.

1.5 Performance and Usage Data

We automatically collect data about how the Application is used, including:

  • Fleet-level inspection pass/fail rates, cargo type breakdowns, and compliance trend metrics;
  • Driver performance metrics (aggregated and anonymized; not individually attributed when shared externally);
  • Tie-down count and WLL calculation patterns by cargo type and weight class (anonymized);
  • Dispute submission rates, override rates, and resolution timelines;
  • Feature utilization, session duration, navigation patterns, and API request metrics;
  • Application errors, crash logs, and diagnostic information;
  • App version, update adoption, and device/OS distribution data.

This information, together with all derived analytics and benchmarks, constitutes “Performance Data” as defined in Section 4.

1.6 SMS Communication Records

We retain records of SMS messages sent for driver account provisioning, including phone number, message timestamp, and delivery status as reported by our SMS provider (Twilio). We do not retain the content of driver replies beyond opt-out signals.

1.7 Support and Communication Records

If you contact MMT for support, we may retain records of those communications and any information provided to assist with your request.

How We Use Your Information

We use the information we collect to:

  • Provide, operate, maintain, secure, and improve the Application and its features;
  • Perform server-side cargo securement rule validation and return inspection results;
  • Generate fleet compliance reports, dashboards, and audit trails for carrier administrators;
  • Authenticate drivers and fleet administrators and manage account access;
  • Process subscription billing and manage payment methods;
  • Send SMS activation codes and account notifications to drivers via Twilio;
  • Store and serve evidence photo URLs to authorized fleet administrator accounts;
  • Analyze Performance Data to improve Application functionality, rules accuracy, and service quality;
  • Comply with applicable legal obligations and respond to lawful government requests;
  • Enforce our Terms of Service and protect MMT’s rights and interests.

Information We Do Not Collect

Important

We do not collect GPS location data, health information, or government-issued identification numbers. We do not use your information for advertising or behavioral profiling. This Application is intended exclusively for commercial transportation professionals.

To be clear about our data practices:

  • We do not collect GPS location data or real-time driver location;
  • We do not collect health information, government-issued identification numbers, or immigration status;
  • We do not collect financial account information beyond what is necessary for subscription billing, and we do not store full payment card numbers;
  • We do not use your information for advertising targeting, behavioral profiling, or any purpose unrelated to operating and improving the Application;
  • We do not knowingly collect information from individuals under eighteen (18) years of age; this Application is intended exclusively for commercial transportation professionals.

Data Ownership

4.1 Performance Data — Exclusively Owned by MMT

Performance Data — including all usage data, fleet-level compliance metrics, anonymized inspection analytics, diagnostic data, cargo type performance benchmarks, driver performance indicators (anonymized), fleet trend data, and all analytics or models derived from your use of the Application — is the exclusive property of Mile Marker Technologies, LLC. MMT owns all Performance Data in perpetuity. Nothing in this Policy, the Terms of Service, or the EULA transfers any ownership interest in Performance Data to you.

BY USING THE APPLICATION, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT MMT OWNS ALL PERFORMANCE DATA AND MAY USE, ANALYZE, AND COMMERCIALIZE PERFORMANCE DATA FOR ANY LAWFUL BUSINESS PURPOSE WITHOUT ADDITIONAL NOTICE OR COMPENSATION TO YOU.

4.2 Carrier Data — Associated With Your Account

Your fleet’s individual, identifiable inspection records (Carrier Data) remain accessible through your carrier account. MMT does not sell individually identifiable Carrier Data to third parties. However, by using the Application, you grant MMT a worldwide, royalty-free, perpetual, irrevocable license to: (a) store, process, and display Carrier Data within the Application; (b) use Carrier Data for application improvement; and (c) aggregate and anonymize Carrier Data to create Performance Data. Once Carrier Data has been aggregated or anonymized, the resulting data constitutes MMT Performance Data subject to Section 4.1.

4.3 Driver Personal Information

Driver names and phone numbers provided by fleet administrators are used exclusively for account provisioning and SMS activation. This information is not sold by MMT to third parties and is handled in accordance with Section 5.

How We Share Your Information

We share information with third parties only as described below. We do not sell or share your individual inspection records or driver personal information with commercial third parties.

5.1 SMS Service Provider

We share driver phone numbers and activation message content with Twilio (or another SMS provider) solely for the purpose of delivering SMS account activation and provisioning messages. SMS providers are not authorized to use driver phone numbers for any purpose other than message delivery on MMT’s behalf.

5.2 Payment Processor

Billing information is shared with Square (or another payment processor) for subscription payment processing. MMT does not store full payment card numbers. Payment data is subject to the payment processor’s privacy policy and PCI DSS standards.

5.3 Cloud Infrastructure

Evidence photos are stored with Amazon Web Services (S3). Usage data and inspection records are stored on cloud database infrastructure. These providers operate under contractual data processing obligations with MMT.

5.4 Legal Requirements and Protection

We may disclose information when required to comply with applicable law, subpoena, court order, regulatory request, or to protect the rights, safety, or property of MMT, our users, or the public.

5.5 Business Transfers

In a merger, acquisition, asset sale, or similar transaction, information — including Performance Data — may be transferred as a business asset. Performance Data is a core proprietary asset of MMT and will transfer with any such transaction.

Data Retention

6.1 Carrier Account Data. Retained as long as your account is active and for a commercially reasonable period after closure to fulfill legal obligations.

6.2 Driver Records. Driver names and phone numbers are retained while associated with your active carrier account and for a reasonable period following account closure or driver deactivation.

6.3 Inspection Records (Carrier Data). Retained for as long as your account is active and for up to three (3) years thereafter, after which records may be deleted or permanently anonymized and incorporated into Performance Data.

6.4 Evidence Photos. Retained in your fleet account while active and for a commercially reasonable period following account closure, subject to cloud storage policies.

6.5 Performance Data. Retained indefinitely as a proprietary MMT business asset. Performance Data that has been aggregated or anonymized is not subject to deletion obligations.

6.6 SMS Records. Delivery records retained for operational and compliance purposes consistent with Twilio’s data retention practices.

Data Security

MMT implements commercially reasonable technical, administrative, and physical safeguards including TLS encryption for data in transit, encryption at rest for sensitive data, role-based access controls, JWT-based authentication, and periodic security assessments. Evidence photos are stored under pre-signed, time-limited URLs with access controls.

No security system is impenetrable. We cannot guarantee absolute security. If you believe your account has been compromised, contact support@milemarkertech.com immediately.

Your Rights and Choices

Subject to applicable law and the data ownership provisions in Section 4:

  • You may access and update your carrier account information through account settings;
  • Fleet administrators may deactivate driver accounts and remove driver records through the fleet console;
  • Drivers may opt out of SMS messages at any time by replying STOP;
  • You may request deletion of your personal account information by contacting support@milemarkertech.com. Note that account deletion does not affect MMT’s ownership or retention of Performance Data;
  • You may contact us to request information about our data practices.

Performance Data, as MMT’s proprietary property, is excluded from individual deletion rights. Carrier Data that has been anonymized into Performance Data cannot be individually extracted or deleted.

Third-Party Services

The Application integrates with third-party services including Square (payment processing), Twilio (SMS delivery), and Amazon Web Services (cloud storage and infrastructure). MMT is not responsible for the privacy practices of these providers. We encourage you to review their privacy policies directly.

Children's Privacy

The Application is intended exclusively for commercial transportation professionals and is not directed to individuals under eighteen (18) years of age. We do not knowingly collect information from minors.

State Privacy Rights

Depending on your state of residence, you may have additional rights under applicable state privacy law (e.g., CCPA). Performance Data, as MMT’s commercial business data, may not be subject to individual access or deletion rights under applicable state law. Changes to This Policy

MMT may update this Policy periodically. We will notify you of material changes through the Application or by email to the account administrator address. Continued use of the Application after the effective date of any update constitutes acceptance of the updated Policy.
